nirvAnA or anywhere else you buy it is just an agent acting on behalf of Blizzard.. as a 'reseller'.. so afaik, when you buy the product, your forming an agreement with Blizzard, not nirvAnA.

If its a reason that's valid (say rejecting the ToS) it may possibly be through blizzard as they will reimburse you for the game and chase up Nirv. Either way it's some type of agreement that Nirv would have entered into as a retailer for the game.
Blizz should be able to tell you one way or the other what the correct procedure is however.

Sorry about getting a bit agro at you chad, your first post did come across as rather condescending but at least you tried to say something of worth
chad is correct, retailers are agents. You have to check out the procedure (I think there are several battle.net forum threads already in the ANZ forums) with Blizzard and see if they are willing to reimburse you. In your case it looks like its a preference to play on NA as you are located in Seoul now. You can play on Asia right? Its like SEA players trying to play on europe, of course we are going to lag lol.
I suggest
1) Finding a different ISP, check with your friends in Korea who has the best ping and if it doesn't cost much to switch do it!
2) As people people previously mentioned use a VPN service.
