It depends on specific stores on whether they are stocking D3 or not.

If the store you bought at isn't stocking you are out of luck - unless you pre-ordered with a credit card, then go and cancel this transaction / get in touch with your bank now!

Bad luck to those who paid in cash. No it's not illegal. You can go on a list of creditors (But really, there is no way you are seeing that money, sorry)

GAME is more expensive than SC2SEA/Bnet/JB Hifi and so on so hopefully not many people pre-ordered it from there.
